PRIVACY POLICY

This policy describes the types of information that SpotOnSite LLC (“Company” or “We”) may collect from you or that you may provide while using the SpotOnSite mobile application (our “App”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

You acknowledge that this Privacy Policy is part of our Mobile Application End User License Agreement, and by accessing or using our App, you agree to be bound by all of its terms and conditions. If you do not agree to these terms, please do not access or use this App.

This policy applies to information that we collect:

  • On this App
  • In email and other electronic messages between you and this App or the Company
  • When you interact with any of our advertising on third-party websites, if those advertisements include links to this policy.

It does not apply to information collected by:

  • Us offline or through any other means; or
  • Any third party, including through any application or content that may be accessible from our App.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our App. By accessing or using this App, you agree to this Privacy Policy. This Policy may change from time to time. Such material changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to issuing an E-mail to the E-mail address on file with the Company and posting the revised Policy on this page. Your continued use of this App after we make changes is deemed to be acceptance of those changes.

Types and Use of Information Collected

The two types of information that are collected through use of our App are Personally Identifiable Information and Non-Personally Identifiable Information. Our primary goal in collecting information from you is to provide you with a smooth, efficient, customized experience while using our App.

Personally Identifiable Information

This refers to information that lets us know the specifics of who you are. When you engage in certain activities on this App, such as registering an account or creating a username, we may ask you to provide certain information about yourself by filling out and submitting a form. Such personal information may include your first and last name, mailing address, E-mail address, company name and information, job title, telephone numbers, a username and password, billing information and other personal identifying information. Also included as information that may personally identify you are records and copies of any of your correspondence with the Company and details of any transactions between you and the Company when you purchase our service.

We do not collect any Personally Identifiable Information about you unless you voluntarily provide it to us through use of our App. Personally Identifiable Information is collected to directly provide our services to you, store a unique user account for you, provide you with notices about your account or our services, or to carry out or enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

Non-Personally Identifiable Information

This refers to information that does not by itself identify a specific individual and is based on your interaction with the App and is compiled on an aggregate basis. This may include location and GPS data and device information. This information is collected automatically and is used to provide the services to you, diagnose problems with our App, or to help us improve our App and deliver a better service.

Disclosure of Your Information

We may disclose your personal information that we collect or you provide:

  • To service providers or other third parties we use to support our business such as payment processors or financial institutions to confirm payment or provide other similar services who are governed by their own privacy policies and obligations
  • To fulfill the purpose for which you provide it and provide our services
  • With your consent
  • As required by law enforcement or judicial authorities upon receipt of a court order, subpoena, or to cooperate with law enforcement
  • To a buyer or successor in the event of a merger or sale of the assets of the Company in which personal information held by the Company is among the assets to be transferred

Updating and Correcting Information

We believe you should have the ability to access and edit the personally identifiable information that you have provided to us. Please include your name, address, and/or E-mail address when you contact us. We encourage you to promptly update your personally identifiable information if it changes.

User Choices on Collection and Use of Information

If at any time you wish to deactivate or close your account, or have any personal information deleted, you can do so by emailing at [email protected]

We may, from time to time, send you E-mails regarding our services, some of which may be for promotional purposes. If you do not wish to receive such emails you may opt out by unsubscribing to them or by writing to [email protected]

Security of Information

You can be assured that your personally identifiable information is secure, consistent with current industry standards. The importance of security for all personally identifiable information associated with our users is of utmost concern to us. Your personally identifiable information is protected in several ways. Access by you to your personally identifiable information is available through a password and unique username selected by you. We recommend that you do not divulge your password to anyone. Information is also stored on a secure server that is only accessed by a limited number of Company personnel.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personally identifiable information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this App cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

Minors

You must be at least 18 years old to have our permission to use this App. Our policy is that we do not knowingly collect, use or disclose personally identifiable information about visitors that are under 18 years of age. Any use by someone under this age is strictly prohibited and will be terminated immediately upon discovery. Further, any personally identifiable information provided by someone under 13 or that identifies someone under this age, will be deleted immediately upon discovery if in violation of this restriction.
